Terms of Service

1. Eligibility

You must be at least 18 years old and legally able to enter into contracts to use digihaus. You may not use the marketplace if you are located in, or are a resident of, any jurisdiction subject to comprehensive sanctions, or if you are on any sanctions or denied-party list.

2. What digihaus is and is not

digihaus is a venue that connects buyers and sellers of digital products. Payments are processed by Stripe: the buyer pays through Stripe Checkout and funds settle to the seller's own Stripe account. The seller is the merchant of record for their sales. digihaus is not a party to any transaction, does not take custody of funds, and does not act as a broker, money transmitter, or escrow agent.

Sellers are responsible for their Stripe account, for complying with Stripe's terms of service, and for any tax obligations arising from their sales.

3. Accounts

You are responsible for the activity under your account and for keeping your credentials secure. You agree to provide accurate information and to keep it current.

4. Seller obligations

If you list a product, you represent that you own it or have all rights necessary to sell it and to grant buyers a license to use it. You are responsible for your listings, your files, the accuracy of your descriptions, your prices, and any taxes arising from your sales.

By listing a product, you grant each buyer a non-exclusive license to use the delivered files for their own lawful purposes, and you grant digihaus the limited rights needed to host, display, and deliver your listing and files.

You may not list anything that violates our Acceptable Use Policy.

5. Buyer obligations

You are responsible for confirming a listing meets your needs before purchasing. Because delivery is instant, all sales are final unless the seller agrees otherwise or applicable law provides otherwise.

6. Fees and subscriptions

Free (base) accounts: digihaus charges a total fee of 5% + 50¢ on each completed sale. This fee is all-inclusive: card processing cost is paid out of it, not added on top, and it is collected automatically at the time of purchase as a combination of the digihaus application fee and Stripe's processing fee. There is no limit on the number of listings.

Pro accounts: sellers with an active digihaus Pro subscription (billed through Stripe at $29 per month, or $288 per year) pay a 0% digihaus platform fee. Pro sellers pay only Stripe's standard card processing on their sales, which digihaus neither sets nor receives. The subscription renews automatically each billing period (monthly or yearly) and can be canceled at any time; Pro benefits continue through the end of the paid period. Subscription payments are for platform services and are non-refundable (see the Refund & Dispute Policy).

Current pricing is shown at digihaus.xyz/pro; we may change fees or plan pricing prospectively with notice, and changes never apply retroactively to already-paid periods.

7. Prohibited conduct

You agree not to use digihaus to infringe intellectual property, distribute malware, launder money, evade sanctions, commit fraud, or violate any law. See the Acceptable Use Policy for details. We may remove listings and suspend or terminate accounts that violate these Terms.

8. Intellectual property

The digihaus name, site, and software are owned by digihaus. Sellers retain ownership of their own products and content.

9. Disclaimers

digihaus is provided “as is” and “as available,” without warranties of any kind, to the fullest extent permitted by law. We do not guarantee the quality, legality, or safety of any listing, the conduct of any user, or uninterrupted or error-free operation.

10. Limitation of liability

To the fullest extent permitted by law, digihaus will not be liable for any indirect, incidental, special, consequential, or exemplary damages, or for any loss of funds, data, or profits, arising from your use of the marketplace.

11. Indemnification

You agree to indemnify and hold digihaus harmless from any claims arising out of your listings, your transactions, your content, or your violation of these Terms or any law.

12. Termination

We may suspend or terminate your access at any time for any violation of these Terms or to comply with law.

13. Governing law & changes

These Terms are governed by the laws of the State of New York, United States. We may update these Terms from time to time; continued use after an update means you accept the revised Terms.
